Auction Terms & Conditions 1. This auction is an Open Consignment auction. 90% of the items are absolute and these items will be sold to the highest bidder at public outcry as determined by the Auctioneer. 2. The Auctioneer has the final say in all price disputes and has the option to reopen an item for bid should a tie or mistake be brough to his/her attention. 3. All winning bids will be considered a binding and legal obligations on the part of the person who holds the winning bidder number. 4. All participants agree to hold harmless Last Chance Auction Company and any of its employees for any statements made as to the workability, value, condition or overall evalution of an item unless it is provided in writing prior to the sale. 5. Last Chance Auction Company and the Auctioneer will make every attempt to explain and describe items with all information at their disposal and all participants agree to hold harmless the Auctioneer and Last Chance Auction Company for any information not forwarded as a result of unknown omissions. 6. Winning an item and not paying for it as prescribed by the check in and out procedures of Last Chance Auction Company will forfeit the ability to participate in future Last Chance Auction Company events furthermore; if an item is removed from the premises without paying it will be considered an act of theft and will be prosecuted to the fullest extent as allowed by law in the in the public court of Minnehaha County. 7. When in doubt ask questions, failure to do so is not the fault of Last Chance Auction Company or the Auctioneer, and anyone who participates agrees to hold themselves accountable for all information they have to base their decisions on when bidding on an item.
